In most cases, the nanny is an employee of the Family. The Family will be responsible for payroll, taxes, and other employment-related matters. In some special cases, the nanny may be an employee of ABN and in those cases ABN will be responsible for the matters listed above.

Factors that may determine whether a nanny is an employee of the agency or the family include:

Who controls the nanny’s work: If the agency controls the nanny’s work schedule, duties, and supervision, then the nanny is likely an employee of the agency. If the Family sets the schedule, then it will be the family who is responsible.
